    When a borrower is behind on the note the lender must follow the terms of the real estate note and deed of trust before a foreclosure can be held.  Notices of a default and intent of foreclosure must be sent by certified mail.  A foreclosure notice must be posted at the county court house adopted site foreclosure notices, twenty one days before the foreclosure can be held.  The foreclosure sale is held at the designated foreclosure site on the first Tuesday of the month between 10am and 4pm.

    This office will do the entire foreclosure, sending out the foreclosure letters, postings, the foreclosure notice, and holding the foreclosure sale, or we will serve as the substitute trustee and hold the foreclosure sale after the foreclosure notices have been mailed.

    When a home equity loan is taken out a lender must file a case in District Court for an order to foreclose, before the foreclosure can be held.  This company will prepare and file the court case or serve as local council.
